The Supreme Court of Canada decision in R. v. Ruzic (2001) formulates a new principle of fundamental justice under section 7 of the Charter. This new principle of fundamental justice holds that notwithstanding that a person committed a crime with the required guilty state of mind, they must not be punished if their actions were "morally involuntary", that is to say if their acts were not the "product of a free will...unhindered by external constraints". This principle relates to defences based on external circumstances. Le premier chapitre sera consacré à l'explication des causes de cette injustice qui résident à notre avis dans l'omniprésence de la régle masculin qui l'emporte sur le féminin qui a été transposée du droit civil au droit criminel et dans la philosophie "masculiniste" qui émane du concept de "l'homme raisonnable" à la base de la légitime défense. Le deuxième chapitre exposera la situation particulière des femmes battues par rapport à la défense qui est prévue dans le Code criminel. L'étude de l'arrêt 'Lavallee' rendu en 1990 témoignera d'une remise en question de l'interprétation traditionnelle dont l'un des volets est un diagnostic d'ordre psychiatrique qui entache la crédibilité et la dignité des femmes. L'étude des répercussions de la décision ' Lavallée' qui occupe le troisième chapitre démontrera finalement que le syndrome de la femmme battue n'a pas fait disparaître l'injustice des annales judiciaires actuelles. Si le droit d'autrefois refusait la légitime défense à la femme battue, le droit d'aujourd'hui la lui concédera sous condition de perturbation mentale. Cette entorse au principe, fondamental du droit à l'égarité que la présente étude met en relief dessert la cause des femmes en créant régime de tutelle dans l'exercice de la légitime défense el milieu congugal." The article begins by outlining theoretical approaches to understanding emotion in philosophy and psychology, and then identifies how these approaches are applied in the defences. The article critizes the law's understanding of emotion for being narrow, gender-biased and inconsistent. It challenges the grounds of knowledge upon which assessments of criminal liability are made and offers a social constructionist approach to understanding emotion as a possible vehicule for reconsidering the defences. It is argued that the social constructionist approach is well suited to the assessment of conduct in its spatial, historical and cultural context, and for this reason ought to be emphasized in the legal assessment of liability" (p. 117)
