The Supreme Court of Canada decision in R. v. Ruzic (2001) formulates a new principle of fundamental justice under section 7 of the Charter. Le deuxième chapitre exposera la situation particulière des femmes battues par rapport à la défense qui est prévue dans le Code criminel. L'étude de l'arrêt 'Lavallee' rendu en 1990 témoignera d'une remise en question de l'interprétation traditionnelle dont l'un des volets est un diagnostic d'ordre psychiatrique qui entache la crédibilité et la dignité des femmes. L'étude des répercussions de la décision ' Lavallée' qui occupe le  troisième chapitre démontrera finalement que le syndrome de la femmme battue n'a pas fait disparaître l'injustice des annales judiciaires actuelles. Si le droit d'autrefois refusait la légitime défense à la femme battue, le droit d'aujourd'hui la lui concédera sous condition de perturbation mentale. Cette entorse au principe, fondamental du droit à l'égarité que la présente étude met en relief dessert la cause des femmes en créant régime de tutelle dans l'exercice de la légitime défense el milieu congugal." I pity a judge who has to instruct a jury on common law and statutory duress, the parties provisions and self-defence thrown in for good measure. The mental and verbal gymnastics mayor may not make for good law school exams (my students routinely invoke section 12 of the Charter when I ask them to interpret Parliament's product) but they are an unnecessary landmine for the judge, let alone the jury."
