RE: REFORM OF THE GENERAL PART OF THE CRIMINAL CODE
 

        I have been asked to respond on behalf of The Honourable Jon Havelock, Minister of Justice and Attorney General of Alberta with respect to your correspondence of September 15, 1998.  In your, you ask if our department submitted a brief in response to the June 1993 document, "Proposals to Amend the Criminal Code (General Principals)".

        I inquired of Michael Allen, who is the Assistant Deputy Minister, Criminal Justice, as to whether or not such a brief was submitted.  He has indicated to me that a brief was not submitted.  He has further indicated to me, even if a brief had been prepared, it would not be released, since such items are prepared and sent to the Federal Government on a confidential basis.  These items often contain references to the opinions that have been put forward by other provinces and territories or the Federal Government itself, which Alberta, in turn, receives on a confidential basis.
