"[Abstract] In 1996, the federal government introduced a series of reforms to the sentencing process.  One of these reforms entailed codification of the purpose and principles of sentencing.  A central goal was to reduce the use of incarceration as a sanction.  However, one provision in this statement singles out Aboriginal offenders.  According to s. 718.(2)(e), judges are enjoined to consider alternatives to custody for all offenders, but 'with particular attention to the circumstances of aboriginal offenders'.  In a previous article published in this journal, the authors argued that this provision represented a well-intentioned yet misguided attempt to reduce the number of aboriginal persons in Canada's prisons.  The authors suggested that the provision could undermine other codified sentencing principles such as parity of treatment.  In the present article, the authors provide some responses to the commentaries on their original paper which are published in this issue of the journal." "In this reply, the authors argue that the data relied upon in Stenning and Roberts' article 'Empty Promises: Parliament, The Supreme Court, and the Sentencing of Aboriginal Offenders' does not support their conclusions that Aboriginal over-representation in prison is not a national problem and that Aboriginal offenders already receive shorter sentences than comparable non-Aboriginal offenders.  The authors then argue that the proper purpose of s. 718.2(e) is to reduce Aboriginal over-representation in prison and not, as Stenning and Roberts have argued, to eliminate discriminatory disparities in the sentencing of Aboriginal offenders.  They suggest that s. 718.2(e) can be justified by theories that relate Aboriginal over-representation in prison to the unique experience of colonialism and not, as Stenning and Roberts suggest, to social and economic disadvantage that Aboriginal offenders may share with other offenders.  Finally, the authors suggest that Stenning and Roberts' arguments against the reference to Aboriginal offenders in s. 718.2(e) are related to implicit assumptions about the needs for equality and sentencing tied to desert.  These assumptions are not in accord with Canadian law, which favours substantive equality or sentencing that is not determined by desert." STUDENT ABSTRACT: This thesis provides a comparative analysis of sentencing patterns in two time periods separated by seventeen years.  Research of this type has not been attempted previously, due to the limited availability of historical sentencing data. Using statistics obtained from the Royal Canadian Mounted  Police's Fingerprint System from 1983-1984 and the Canadian Centre for Justice Statistics' Adult Criminal Court Survey for 1999-2000, this study examines whether recommendations made by  various federal inquiries into sentencing have affected judicial decision-making at the trial court level. At the core of this discussion is an examination of those initiatives aimed at reducing the use of imprisonment as a sanction. Comparisons reveal that sentencing patterns in 1983-1984 differed significantly from those present in 1999-2000.  In some cases, it appears as though the changes were in accordance with recommendations of the federal inquiries whereas in others, the patterns that were discovered seemed to indicate that judges ignored or even defied the directives given. With regard to the promotion of community sanctions, there was an overwhelming increase in the use of probation.
